1. Definitions

Additional agreement: an agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance contract and these goods, digital content, and/or services are delivered by ClothesForYou&Me or by a third party based on an arrangement between that third party and ClothesForYou&Me;

Reflection period: the period within which the consumer can exercise their right of withdrawal;

Consumer: the natural person who does not act for purposes related to their trade, business, craft, or profession;

Day: calendar day;

Digital content: data produced and supplied in digital form;

Duration contract: an agreement aimed at the regular delivery of goods, services, and/or digital content during a specified period;

Durable medium: any tool — including email — that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation or use during a period aligned with the purpose of the information and allows unchanged reproduction of the stored information;

Right of withdrawal: the consumer's ability to cancel the distance contract within the reflection period;

Distance contract: an agreement between ClothesForYou&Me and the consumer concluded within the framework of an organized system for distance selling of products, digital content, and/or services, where one or more means of distance communication are used up to and including the conclusion of the agreement;

Model withdrawal form: the European model withdrawal form included in Annex I of these terms and conditions;

ClothesForYou&Me: the legal entity as defined in Article 2, offering products, (access to) digital content, and/or services remotely to consumers as set out in these general terms and conditions;

Means of distance communication: any means that can be used for concluding an agreement without the consumer and entrepreneur being physically present in the same place simultaneously.

Article 3 – Applicability

These general terms and conditions apply to every offer of ClothesForYou&Me and to every distance contract concluded between entrepreneur and consumer.

Before concluding the distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, ClothesForYou&Me will indicate how the terms can be viewed and, upon request, will send them to the consumer free of charge as soon as possible.

If the distance contract is concluded electronically, the text of these terms and conditions may be provided electronically in a way that the consumer can easily store it on a durable medium. If this is not reasonably possible, ClothesForYou&Me will indicate where the terms can be consulted electronically and that they will be sent free of charge upon request.

If, in addition to these general terms and conditions, specific product or service terms apply, paragraphs 2 and 3 apply accordingly, and the consumer can always rely on the most favorable provision in case of conflicting terms.

Article 4 – The Offer

If an offer has a limited validity or is conditional, this will be clearly stated in the offer.

The offer contains a complete and accurate description of the offered products, digital content, and/or services. The description is sufficiently detailed to allow the consumer to assess the offer properly. If ClothesForYou&Me uses images, these are a truthful representation of the offered products, services, and/or digital content. Obvious mistakes or errors in the offer do not bind ClothesForYou&Me.

Each offer includes such information that the consumer understands their rights and obligations related to accepting the offer.

Article 5 – The Agreement

The agreement is concluded, subject to paragraph 4, at the moment the consumer accepts the offer and meets the conditions attached to it.

If the consumer has accepted the offer electronically, ClothesForYou&Me will immediately confirm receipt of acceptance electronically. Until confirmation is received, the consumer may dissolve the agreement. After confirmation, dissolution is no longer possible, but the consumer may still exercise the right of withdrawal (Article 6).

When concluding the agreement electronically, ClothesForYou&Me will take appropriate technical and organizational measures to secure the electronic data transfer and ensure a safe web environment. If electronic payment is possible, ClothesForYou&Me will apply appropriate security measures.

ClothesForYou&Me may, within legal limits, check whether the consumer can fulfill their payment obligations and other factors relevant for responsibly entering the distance contract. If there are valid grounds not to enter the agreement, ClothesForYou&Me may refuse the order or apply special conditions.

ClothesForYou&Me will provide, at the latest upon delivery of the product, service, or digital content, the following information in writing or on a durable medium accessible to the consumer:

The visiting address of ClothesForYou&Me where complaints can be filed;

Conditions and manner for exercising the right of withdrawal or a clear notice if the right is excluded;

Information about guarantees and after-sales service;

Price including all taxes, delivery costs if applicable, and payment, delivery, or execution method;

Requirements for terminating the contract if longer than one year or indefinite;

If applicable, the model withdrawal form.

For duration contracts, the information under paragraph 5 applies only to the first delivery.

Article 6 – Right of Withdrawal
The consumer can cancel a purchase agreement within a minimum reflection period of 14 days without giving any reason. ClothesForYou&Me may ask for the reason but cannot oblige the consumer to provide one.

The reflection period starts the day after the consumer, or a third party designated by the consumer (other than the carrier), receives the product—or, in case of multiple products ordered, after the last product is received.

For services and digital content not delivered on a tangible medium, the consumer also has at least 14 days to withdraw, starting from the day after the agreement is concluded.

If ClothesForYou&Me fails to inform the consumer about the right of withdrawal or the model withdrawal form, the reflection period is extended by up to twelve months plus 14 days after receiving that information.

Article 7 – Consumer’s Obligations During the Reflection Period
The consumer must handle the product and packaging with care and may only unpack or use the product to the extent necessary to determine its nature, characteristics, and functioning, similar to how it is allowed in a physical store.

The consumer is only liable for any diminished value caused by handling the product beyond this.

The consumer is not liable for diminished value if ClothesForYou&Me did not provide the legally required information about the right of withdrawal.

Article 8 – Exercising the Right of Withdrawal and Costs
The consumer must notify ClothesForYou&Me of withdrawal within the reflection period via the model withdrawal form or in an unequivocal manner.

The product must be returned within 14 days after notification of withdrawal.

The consumer bears the direct costs of returning the product unless ClothesForYou&Me has agreed to cover these costs or failed to inform the consumer otherwise.

For digital content not supplied on a tangible medium, special rules apply regarding the consumer’s prior consent and acknowledgment of loss of the withdrawal right.

All additional agreements related to the original agreement are automatically terminated upon withdrawal.

Article 9 – Obligations of ClothesForYou&Me Upon Withdrawal
If withdrawal can be notified electronically, ClothesForYou&Me will immediately confirm receipt.

ClothesForYou&Me reimburses all payments, including delivery costs charged for the returned product, without undue delay and within 14 days after notification of withdrawal.

Reimbursement is via the same payment method used by the consumer unless otherwise agreed, and at no cost to the consumer.

Additional costs for a more expensive delivery method chosen by the consumer are not reimbursed.

Article 10 – Exclusion of the Right of Withdrawal
ClothesForYou&Me may exclude the right of withdrawal for specific products or services if clearly stated before the agreement is concluded, such as:

Products with prices subject to financial market fluctuations beyond ClothesForYou&Me’s control;

Agreements concluded during a public auction;

Services fully performed with the consumer’s prior consent and acknowledgment of loss of withdrawal right;

Accommodation services with a specified date;

Leisure activities with a specific date or period;

Custom-made or personalized products;

Perishable goods;

Sealed products that are not returnable for health or hygiene reasons after unsealing;

Products mixed inseparably after delivery;

Alcoholic beverages delivered after 30 days, with price dependent on market fluctuations;

Sealed audio, video, or software products after unsealing;

Newspapers or magazines (except subscriptions);

Digital content delivery, after consumer’s prior consent and loss of withdrawal right.

Article 11 – Price
Prices offered remain valid during the validity period stated in the offer.

Price increases within 3 months after conclusion of the agreement are only allowed due to legal changes (e.g., VAT).

Price increases after 3 months are only permitted if agreed upon and due to legal changes or if the consumer can terminate the agreement with effect from the price increase date.

Prices include VAT.

Article 12 – Performance of Agreement and Additional Guarantee
ClothesForYou&Me guarantees that products/services meet the agreement, reasonable standards of quality and usability, and applicable legal requirements.

Any additional guarantees provided do not limit the consumer’s statutory rights in case of non-performance by ClothesForYou&Me.

Additional guarantees mean any commitments going beyond legal obligations granted by ClothesForYou&Me or its suppliers.
